Please read carefully. This pertains to your purchase (and to your usage of) all Products sold by WebSharks, Inc. It is very important to read & understand our policies before you purchase Products from us.
- "User(s)" means any and/or all persons who establish or access a connection to a site in the WebSharks, Inc. network.
- "Customer(s)" or "Member(s)" means any and/or all persons gaining additional or paid access to Products and/or Services provided by WebSharks, Inc.
- Contextual references to "you" or "your" or "you're" indicates You (i.e. the User or Member), depending upon your current status with our company.
- "Product(s)" or "Software" is a reference to any and/or all software (free or paid) that is produced and/or distributed by WebSharks, Inc.
- "Services" means an act or deed performed by WebSharks, Inc. (or by our Software, or a site in our network).
- Contextual references to "WebSharks" or "we" or "us" or "our" or "our network" always refers to WebSharks, Inc. as an online entity (i.e. our company). This includes other sites within our our network; e.g. other divisions of WebSharks, Inc. that might be located on a different domain but still operated by WebSharks, Inc.
Gaining Download Access
THE REGISTRATION/CHECKOUT PROCESS
Access to our Products is provided immediately after you've paid for your order. Upon completing registration/checkout, you may log into your account for instant access. We will also send you an email after registration/checkout with a link to the login page for your account.
All Products are delivered digitally, via file downloads available through your account on-site.
WordPress® and Browser Compatibility
FUTURE-PROOFING / SOFTWARE COMPATIBILITY WITH WORDPRESS®
All of our Products are designed to be compatible with the latest available version of WordPress®. We also make every effort to future-proof our Products in a variety of ways, so they'll remain compatible in future versions of WordPress® too — for as long as possible.
Of course, there are exceptions; we're not perfect. We can give no guarantee that all Products will remain functional in future versions of WordPress®. If something major changes in a new version of WordPress® and updates or improvements are needed, they will be made available on our website and/or released to existing Customers with access to such updates.
CROSS-BROWSER COMPATIBILITY / W3C STANDARDS COMPLIANCE
Our Products support all modern web browsers. Including, but not limited to: Firefox, Safari, Google Chrome, Opera & Internet Explorer. While we strive to give every Product a seamless & near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to XHTML & CSS) in some of these browsers; particularly with early versions of Internet Explorer®. In the case of a particular browser (or a particular browser version) not supporting certain web standards, we will include a generic workaround for that browser (when possible); which will degrade a specific function/feature gradually, and in a way that doesn't affect the user experience negatively.
Software Licensing Terms
WORDPRESS® / GNU GENERAL PUBLIC LICENSE (GPL)
Our Products are licensed under the terms of the GNU General Public License (GPL); as is WordPress® itself. The GPL allows both personal and/or commercial use. You are free to modify and adapt our Products to fit your purposes, or for the purposes of your clients.
PRO VERSIONS OF OUR SOFTWARE ARE COMPRISED OF TWO PARTS:
All PHP code (and integrated HTML) in the "Pro" versions of our Software; has been released under a GNU General Public License (GPL) — just like WordPress® itself. You can redistribute the source code and/or modify it under the terms of the GNU General Public License as published by the Free Software Foundation. Please see: http://www.gnu.org/licenses/gpl.html
With the exception of any Additional Acknowledgments (please see the
/licensing/directory that came with the Product(s) you purchased from WebSharks.
Unless you have our prior written consent, you must NOT directly or indirectly license, sub-license, sell, resell, or provide for free; part (2) of our "Pro" Software; or make an offer to do any of these things. All of these things are strictly prohibited with part (2) of our "Pro" Software applications.
SUPPORT FOR "PRO" SOFTWARE (SINGLE-SITE LICENSE vs. UNLIMITED-SITE LICENSE)
Single-Site License: This provides support for one instance of the Product(s) that you purchase. Perfect for site owners with one domain name. It offers you pro features at an affordable rate. It's a popular choice for many.
Multisite Networks: If you run a WordPress® Multisite Network with a Product activated on multiple child blogs or sub-sites within your Network (regardless of whether you use sub-domains or sub-directories), this will always require our Unlimited-Site License. This is because our Products run as a separate instance on each child blog or sub-site in the Network. To clarify, a Single-Site License does NOT provide support for multiple child blogs or sub-sites, even if they do run within a single Multisite Network installation of WordPress®. A Single-Site License is valid for one instance only.
Unlimited-Site License: This provides support for an unlimited number of Product instances. Perfect for site owners with multiple domain names, and/or those who operate a WordPress® Multisite Network installation. Each of your Product instances must be installed/activated on domains that you own & operate; e.g. you cannot buy an Unlimited-Site License and use it on client sites that you do not own.
If you're a developer: Your clients will need to purchase their own Single Site and/or Unlimited Site License. We don't support Product instances on domains that you do not own and operate yourself. We invite all developers to join our affiliate program and refer their clients to us. Your clients may purchase a Product of their own — you receive a commission. This also gives your clients access to future releases through an account they'll acquire at our website. It's the approach we suggest for all developers working w/ clients.
ANNUAL RENEWAL FEE FOR CONTINUED ACCESS TO "PRO" SOFTWARE SUPPORT/UPDATES
When you purchase a "Pro" Product, each purchase includes one year (365 days) of access to support. See: Support Policy. You will also receive access to Product updates released in that time period, at no extra charge. After one year, you may continue to use the Product for as long as you wish. However, if you need ongoing support and/or access to future releases of the Product you purchased, a small renewal fee is required. Please check your "My Account" page on the site where you purchased the Product, for details regarding the renewal of your account.
Refund Policy (Digital Goods)
Since WebSharks is offering digital goods which are non-tangible & irrevocable; we generally do NOT issue refunds. During checkout, upon clicking the "Submit" button, your purchase is charged to the credit/debit card that you supplied. All sales are final. You cannot cancel a purchase or receive a refund for a purchase. Please test the free version of our Products and ask questions before purchasing.
However, we will consider a refund within the first 30 days of your purchase if you are unable to install a Product. Or, if the Product fails to perform basic functions, as designed. And, you HAVE already worked with and followed all advice presented by our support team in an effort to resolve these issues.
Any refunds that are processed will be granted at the sole discretion of WebSharks, Inc. No refunds will be given after 30 days from the initial purchase whatsoever. Digital Products sold by WebSharks are irrevocable. By purchasing a Product from WebSharks you agree to the terms of our Refund Policy. You cannot cancel a purchase or receive a refund for a purchase.

Our Products are provided "as is" without warranty of any kind, either expressed or implied. We shall not be liable for any damages, including, but not limited to: direct, indirect, special, incidental or consequential damages, or other losses arising out of the use of, or inability to use our Products.
SITE DESIGN & CONTENT OWNERSHIP
All site content by WebSharks including, but not limited to: design concepts, scripts, layouts, images, videos, manuals and other documentation; is the property of WebSharks, Inc. Content from this site (and from other sites in our network) shall not be used or exploited for commercial or non-commercial purposes, without the prior written consent of WebSharks, Inc.
Warranty / Guarantee; Liability Limitation
We do not warranty or guarantee our Products in any manner. We cannot guarantee our Products will function with all 3rd-party components, plugins or web browsers. In addition, we are not responsible for any 3rd-party theme or plugin compatibility conflicts that may occur.
It is our policy to support all our Products as best we can. However, we will only provide assistance resolving 3rd-party theme or plugin conflicts at our own discretion; as time allows. Please report any known conflicts to a support representative for review. We may offer suggestions or alternatives.
We are not responsible for any data loss that may occur as a result of installing, running, and/or uninstalling any Product. Please remember to backup your files & database before installing, running, upgrading, and/or uninstalling any Product. If data loss does occur, please report it to a support representative for review. We may offer helpful advice.

We reserve the right to change or modify our current Terms & Conditions with no prior notice. If we decide to change our Terms & Conditions we will post those changes on this page and/or update the modification date below. Policy changes related to the purchase of a Product License will apply only to Products purchased after the date of the change.
